Recently I’ve been concerned about the legal risk associated with selling mephedrone in the UK. From the research that I’ve carried out it seems that the only possible legal action that could be taken against someone selling mephedrone would be that they were in violation of the medicines act 2003. If you’re asking yourself when mephedrone is likely to be banned in the UK really that is an impossible question to answer. There is a wide speculation as to when it is realistically likely to happen, due to a number of factors. Before now it was said that mephedrone was likely to be legal until early next year 2011. Anyone found to be selling it as a medicinal product would be in violation of the medicines act 2003 and would most certainly be prosecuted and could face imprisonment up to 2 years. The medicines act is quite a complex act in regards to research chemicals sold with the disclaimer NOT FOR HUMAN CONSUMPTION.

Any person or website found to be selling mephedrone would be investigated and if found to be selling it for human consumption would be facing prosecution. If you were found to be selling it for research purposes and you were accused of selling it for human consumption with no evidence of this it is likely that you may be in violation of the medicines act 2003. According to the medicines act any person found to be selling a relevant medical product without holding a community or UK authorisation in respect of that product, or otherwise than in accordance with the terms of such an authorisation, shall be found guilty of an offence. If you are found guilty of selling a product that is considered to be in violation of the medicines act the department would serve a notice for you to stop selling or marketing that product by a specified date. If you then chose to carry on selling the product after the date of which they have specified that you to stop you will be found guilty of an offence and could face a fine not exceeding £5000 and or imprisonment up to 2 years. So as long as you stopped selling the product before the date in which they specified no further charges could be brought against you. In other words if you are found in possession of mephedrone and intending to supply it as a research chemical only NOT FOR HUMAN CONSUMPTION the worst that is likely to happen is that you will lose your stock and it is possible that you would have to stop selling the product and you may get a little bit of a telling off.

As for the recent action to try and shut down websites selling mephedrone this is done not because of the law and not necessarily by the police or any government officials. It is more to do with the recent bad press in relation to mephedrone. The reason websites are being shut down is basically because trading terms and conditions for taking credit card payments are being broken. It is currently against the terms and conditions of 99% of card processors to take payments for drugs paraphernalia. It is mainly for this reason why some websites are being closing down. The other possibility for website closures is down to web hosting companies suddenly deciding that they don’t agree with mephedrone and are stopping hosting websites involved in the marketing or sale of it. This is bollocks really as it should be up to the website owner to put anything they wish on their web pages as long as it is not against the law.

So for now mephedrone remains legal in the UK and it is likely that it will stay that way for about 2-6 months. For now just make sure your careful with how you go about selling mephedrone as it is sold strictly NOT FOR HUMAN CONSUMPTION.
